The information contained in this web site constitutes a legally binding agreement between Cospin ("Company", "we", "us", or "our") and you, the parent or legal guardian ("Parent" or "User") of the child using the KushiKid ecosystem. By activating the KushiKid device, you agree to be bound by these terms in their entirety.
This Information is intended for parents and legal guardians in India. If you are accessing KushiKid from outside India, additional terms may apply.
1. Introduction & Scope
KushiKid is designed to help your child build habits — not to capture their attention or
collect their data.
Here is what that means in practice:
• We only collect what is needed to run routines, rewards, and progress tracking
• We do not sell or monetize your child’s data
• We do not show ads or build behavioural profiles
• Voice interactions are processed securely, not used for tracking or advertising
• You, as a parent, remain fully in control of your child’s data and experience

1. Introduction & Scope
KushiKid is a child-centric IoT ecosystem designed to nurture healthy habits, structured routines, and positive behaviour in children aged 4–13 years. The platform includes:
•KushiKid Smart Device — a child-safe interactive hardware device
• KushiKid Mobile Application — available on Android and iOS for parental management
• KushiFM — curated audio content including stories, affirmations, and learning programs
• KushiCircle — a community and progress-sharing platform for families
These Terms & Conditions ("Terms"), together with the Privacy Policy and Parental Consent provisions contained herein, govern all use of the KushiKid platform. Where any conflict exists between these sections, the more protective provision for the child shall prevail.
2. Contracting Party & Eligibility
2.1 The contracting party must be a parent or legal guardian who is at least 18 years of age and legally capable of entering into binding agreements under Indian law.
2.2 The child ("Minor User") is an authorised user of the KushiKid ecosystem solely under parental supervision and consent. The child is not a party to these Terms.
2.3 By registering, you represent and warrant that:
•You are the parent or legal guardian of the registered child
•All information provided during registration is accurate, complete, and current
•You will maintain the security of your account credentials
•You will promptly notify KushiKid of any unauthorised access
2.4 KushiKid reserves the right to verify parental status/ guardianship status and may suspend accounts where the verification fails.
3. Accounts & Profiles
3.1 Account Creation: Parents must create a parent account using a valid mobile number or email address. One parent account may support multiple child profiles, however for Beta this is not available.
3.2 Child Profiles: Profiles may include the child's name or nickname, age, gender, interests, learning goals, and routine schedules. Parents are responsible for the accuracy of profile information.
3.3 Account Security: You are solely responsible for all activity occurring under your account. Use of strong passwords and two-factor authentication (where available) is strongly recommended.
3.4 Account Termination: Parents may close their account at any time by contacting support@kushikid.com . Upon closure, all child data will be deleted within 30 days, subject to any legal retention obligations.
3.5 Inactive Accounts: Accounts with no activity for 24 consecutive months may be deactivated. You will be notified 30 days prior to deactivation.
4. Description of Services
4.1 Core Features
•Habit tracking with daily routines and milestone celebration
•Positive reinforcement through audio cues, visual feedback, and Kushi Stars
•Parental dashboard with real-time progress monitoring
•Customisable reward and goal-setting systems
4.2 KushiFM
•Curated audio library including bedtime stories, guided affirmations, and educational content
•Content is age-gated and reviewed for child-appropriateness
•KushiFM content is streamed.
4.3 KushiCircle
•Community feature enabling families to share milestones
•All shared content is reviewed before publication
•No direct messaging between children is permitted
4.4 Kushi Stars
•Non-transferable, non-monetary digital reward points awarded for completed habits
•Stars have no cash value and cannot be exchanged, sold, or transferred
•KushiKid reserves the right to modify or discontinue the Stars system with 30 days' notice
4.5 Service Availability
KushiKid’s service availability is dependent on a combination of systems and services, some of which are operated and controlled by us, and others that are managed by third parties. While we do not have full control over all dependencies, we are committed to maintaining minimal service disruption and will use commercially reasonable efforts to ensure maximum service uptime.
5. Device Interaction & Permissions
5.1 Service Commitment
We will endeavour to maintain 99% uptime and will provide advance notice of scheduled maintenance. The KushiKid device and application require certain device permissions to function. By granting these permissions, you consent to the following limited uses:
5.2 Bluetooth
•Used exclusively for pairing between the mobile app and KushiKid device
•No data is transmitted externally via Bluetooth
5.3 Microphone
•Activated only during active child interaction sessions
KushiKid does not use wake-word or always-on listening. All interactions happen through a Push-to-Talk (PTT) mechanism, meaning the device only listens when you or your child actively initiates it.
5.4 Push Notifications
•Used to deliver routine reminders, habit milestones, and important account alerts
•Notification preferences are fully configurable within the app
5.5 Location
•Exact location data is NOT collected, however the general proximity of the area defined by PIN code is collected used by KushiKid to offer services and offerings through KushiCircle.
6. Safety & Acceptable Use
6.1 KushiKid is designed as a supervised child product. Parents agree to:
•Supervise the child's use of the device and application appropriate to the child's age
•Ensure the device is used only for its intended purpose
•Not allow unauthorised third parties to access the child's account via mobile app or device
6.2 Prohibited Conduct: The following actions are strictly prohibited:
•Tampering with, reverse engineering, or modifying the KushiKid device or software
•Using the platform to collect or harvest data about other users
•Uploading inappropriate, harmful, or unlawful content to any of Kushi platform feature
•Impersonating another parent, child, or KushiKid representative
•Circumventing parental controls or security measures
•Using KushiKid for any commercial purpose without written consent
6.3 Device Safety: The device is intended for children aged 4 and above under adult supervision. Parents must ensure the device is used in accordance with the physical safety instructions provided in the product manual.
6.4 Reporting: Parents are encouraged to report any concerns about inappropriate content or safety issues to support@kushikid.com KushiKid will investigate all reports within 5 business days.
7. Intellectual Property
7.1 All content, software, design, branding, audio, visuals, and technology comprising the KushiKid ecosystem are the exclusive intellectual property of Cospin or its licensors, protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and applicable intellectual property laws.
7.2 You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the KushiKid platform solely for personal, non-commercial family use.
7.3 You may not copy, reproduce, distribute, publicly display, or create derivative works from any KushiKid content without prior written authorisation.
7.4 User-generated content uploaded to KushiCircle (e.g., milestone photos or captions) remains the intellectual property of the parent but grants KushiKid a limited licence to use such content within the platform.
8. Subscription, Billing & Refunds
8.1 Subscription Plans: KushiKid may offer free and premium subscription tiers. Premium features require a paid subscription as described on the pricing page at kushikid.com.
8.2 Cancellation: You may cancel at any time through the app settings or by contacting support@kushikid.com. Cancellation takes effect at the end of the current billing period.
8.3 Refund Policy:
•No refunds are issued for partial billing periods
•Refund requests due to technical failure must be submitted within 7 days of the issue
•Refunds for device purchases are subject to the hardware return policy
8.4 Price Changes: KushiKid may adjust subscription pricing with 30 days' prior notice. Continued use after the effective date constitutes acceptance of the revised pricing.
8.5 Taxes: All prices are exclusive of applicable GST or other taxes, which will be itemised on your invoice.
9. Privacy Policy
KushiKid is committed to the highest standards of child data protection. We comply with the Information Technology Act, 2000, the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 ("SPDI Rules"), and the Digital Personal Data Protection Act, 2023 ("DPDPA").
9.1 Data We Collect
Parent Data:
•Name, email address, and mobile number
•Payment transactions (processed via PCI-DSS compliant third-party gateways; card details are not stored by KushiKid)
•Device identifiers and IP address
Child Data (provided by parent):
•Name/nickname, age, gender
•Routine preferences, habit data, and goal progress
•Kushi Stars balance and usage history
Automatically Collected Data:
•App usage logs and interaction timestamps
•Device model, operating system version
•Crash reports and diagnostic data
9.2 Data We Do NOT Collect
•Voice recordings or audio transcripts automatically, unless PTT (Push to Talk) is used
•Exact location data
•Biometric data
•Behavioural advertising profiles
•Any data from children without explicit parental consent
9.3 How We Use Data
•To operate, personalise, and improve the KushiKid platform
•To send routine reminders, milestone notifications, and service updates
•To generate aggregated, anonymised analytics for product improvement
•To comply with legal obligations
•To investigate safety reports and enforce these Terms
9.4 Data Sharing
KushiKid does NOT sell, rent, or commercially exploit personal data. Data may be shared with:
•Service providers (e.g., cloud hosting, payment processors, event organizers) under strict data processing agreements
•Law enforcement or regulators where required by applicable law
•Acquirers in the event of a merger or acquisition, with prior notice to users
9.5 Data Retention
•Active account data is retained for the duration of the subscription
•All profile data will be deleted within 30 days of account closure
•Payment records may be retained for up to 7 years for tax compliance
•Anonymised aggregate analytics data may be retained indefinitely
9.6 Data Security
KushiKid employs industry-standard security measures including AES-256 encryption for data at rest, TLS 1.2+ for data in transit, role-based access controls, regular penetration testing, and a formal incident response plan. In the event of a data breach affecting personal data, the concerned parties will be notified within 72 hours.
9.7 Cross-Border Transfers
Data is primarily stored and processed in India. If any data is processed outside India (e.g., by a cloud infrastructure provider), KushiKid ensures adequate contractual safeguards are in place consistent with the DPDPA.
10. Parental Consent Framework
10.1 Basis of Processing: All processing of a child's personal data is based on verifiable parental consent as required under the Digital Personal Data Protection Act, 2023 and applicable UNICEF and international best practice guidelines for child-safe digital products.
10.2 Consent Collection: Consent is collected at onboarding via:
•An explicit, unbundled checkbox affirming acceptance of these Terms and Privacy Policy
•Mobile number OTP verification confirming the consenting adult's identity
•In-app consent logs with timestamps, retained as evidence of consent
10.3 Granular Consent: Parents may independently control consent for:
•Core service features (mandatory for platform operation)
•KushiCircle community features (optional)
•Aggregated product analytics (optional)
•Marketing communications (optional)
10.4 No Profiling of Children: KushiKid does not build individual behavioural profiles of children for advertising, content recommendation, or commercial profiling purposes.
11. Data Rights
Under applicable Indian law, including the DPDPA 2023, parents (as Data Principals in relation to their child's data) have the following rights:
•Right of Access — Request a copy of all personal data held about you and your child
•Right to Correction — Request correction of inaccurate or incomplete data
•Right to Erasure — Request deletion of personal data (subject to legal retention obligations)
•Right to Portability — Receive child data in a structured, machine-readable format
•Right to Grievance Redressal — Lodge a complaint with KushiKid's Data Protection Officer
•Right to Nominate — Nominate another person to exercise rights in the event of death or incapacity
To exercise any of these rights, please contact our Data Protection Officer at support@kushikid.com. We will respond within 30 days of receiving a verified request. Where a request requires more time, we will notify you of the extended timeline.
12. Third-Party Services & Links
12.1 All third-party processors engaged by KushiKid are contractually bound to process data only as instructed by KushiKid and to maintain appropriate security standards.
12.2 KushiKid may integrate with or link to third-party services (e.g., payment gateways, cloud infrastructure). These third parties have their own privacy and data policies which KushiKid may not directly control.
12.3 KushiFM content may be sourced from licensed third-party content providers. Such content remains the intellectual property of its respective owners.
13. Limitation of Liability
13.1 To the maximum extent permitted by applicable law, KushiKid's total cumulative liability for any claims arising from or related to these Terms shall not exceed the total subscription fees paid by you in the 12 months immediately preceding the claim.
13.2 KushiKid shall not be liable for:
•Indirect, incidental, special, consequential, or punitive damages
•Loss of data, revenue, profits, or goodwill
•Interruption of service due to dependent third-party failures
•Damages arising from your failure to maintain account security
•Damages arising from the child's use of the device in an unsupervised or unintended manner
14. Disclaimer of Warranties
14.1 KushiKid is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the platform's fitness for a particular purpose, uninterrupted availability, or freedom from errors.
14.2 KushiKid does not guarantee specific behavioural outcomes, developmental improvements, or habit formation as a result of using the platform.
15. Indemnification
You agree to indemnify, defend, and hold harmless KushiKid, its officers, directors, employees, and licensors from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from:
•Your breach of these Terms
•Your violation of any applicable law
•Content you upload to KushiKid or the platform
•Your child's use of the platform in a manner inconsistent with these Terms
16. Modifications to Terms
16.1 KushiKid reserves the right to update these Terms at any time. Material changes will be communicated via:
•In-app notification at least 30 days prior to the effective date
•Email to the registered parent email address
16.2 Continued use of the platform after the effective date of changes constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must discontinue use and may request account closure.
17. Suspension & Termination
17.1 KushiKid may suspend or terminate your account with immediate effect if you:
•Materially breach these Terms
•Engage in prohibited conduct described in Section 6
•Provide false information during registration
•Fail to make payment when due
17.2 Upon termination, your licence to use the platform ceases immediately. Provisions of these Terms that by their nature should survive termination (including data rights, liability limitations, and governing law) shall continue in effect.

18.1 KushiKid has appointed a Grievance Officer as required under the Information Technology Act, 2000 and the Consumer Protection Act, 2019:

18.3 If your grievance is not resolved to your satisfaction, you may approach the Data Protection Board of India (once constituted under the DPDPA 2023) or a consumer forum of competent jurisdiction.
19. Governing Law & Dispute Resolution
19.1 These Terms are governed by and construed in accordance with the laws of the Republic of India, without regard to conflict of law principles.
19.2 Dispute Resolution Process:
•Step 1 — Informal Resolution: Parties shall attempt to resolve disputes informally by contacting support@kushikid.com within 30 days of the dispute arising
•Step 2 — Mediation: If informal resolution fails, parties agree to attempt mediation before a mutually agreed mediator in Chennai, India
•Step 3 — Arbitration: Disputes not resolved through mediation shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996, conducted in [Insert City] in the English language
19.3 Consumer Protection: Nothing in this Section limits a consumer's rights under the Consumer Protection Act, 2019, including the right to approach consumer forums.
19.4 Courts: Subject to the arbitration clause, the courts in [Insert City], India shall have exclusive jurisdiction.
20.1 KushiKid is designed and operated in compliance with:
•The Protection of Children from Sexual Offences (POCSO) Act, 2012
•The Juvenile Justice (Care and Protection of Children) Act, 2015
•The Digital Personal Data Protection Act, 2023 (DPDPA) — including provisions specific to children's data
•The Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021
•UNICEF's Guidelines on Child Online Safety
20.2 Content Moderation: All content accessible to children through KushiKid — including KushiFM audio and KushiCircle posts — is subject to pre-publication review against our Child Safety Content Policy.
20.3 Mandatory Reporting: KushiKid will report any child abuse material or credible safety threats to appropriate law enforcement authorities as required by law.
20.4 Age Verification: KushiKid takes reasonable steps to verify that account holders are adults. Where we have reason to believe a minor is attempting to create a parent account, we will suspend registration pending verification.
21. Accessibility & Inclusivity
KushiKid is committed to designing an inclusive product. We strive to maintain compliance with WCAG 2.1 Level AA accessibility standards for the mobile application. Users with accessibility requirements may contact us at support@kushikid.com for support.
22. Miscellaneous
22.1 Entire Agreement: These Terms, together with the Privacy Policy and any supplementary agreements, constitute the entire agreement between you and KushiKid.
22.2 Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force.
22.3 Waiver: Failure to enforce any provision shall not constitute a waiver of KushiKid's right to enforce it in the future.
22.4 Assignment: You may not assign or transfer your rights under these Terms without prior written consent. KushiKid may assign its rights in connection with a merger, acquisition, or sale of assets.
22.5 Force Majeure: KushiKid shall not be liable for failures caused by events beyond its reasonable control, including natural disasters, cyberattacks by third parties, government actions, or pandemic-related disruptions.
22.6 Language: These Terms are drafted in English. Any translated version is for convenience only; the English version shall prevail in the event of conflict.
